Dr. George Tiller Is Not Guilty; Phill Kline Offers Legal Advice

Dr. George Tiller was found not guilty yesterday of all 19 misdemeanor charges stemming from some abortions he performed at his Wichita clinic in 2003.

Phill Kline, the former Kansas attorney general who started the investigation into Dr. Tiller's clinic more than four years ago, expressed frustration at the office of the current attorney general and the prosecutors who tried the case, noting that they simply aren't criminal and zealot-y enough to get the job done:

"You do not win cases nor achieve justice by calling one witness and ordering your staff not to initiate any additional effort to gather evidence," Kline said in a written statement.


Truer words have simply never been spoken (hence, the large print)! To win cases for Teh Cause you must follow Phill Kline's example to the letter and initiate any and all additional efforts that serve Teh Cause.

Like so:

2005 -- As Kansas Attorney General on a fishing expedition, when obtaining redacted patient medical records (no name; identifying numbers), cross-reference patient file numbers with abortion records at the Kansas Department of Health and Environment, then subpoena records from Wichita’s La Quinta Inn, where patients are staying, to match dates with names.

2007 -- When you lose your re-election bid for Kansas attorney general (November 2006) and accept an appointment as Johnson County District Attorney, prior to leaving the Kansas AG office (January 2007), steal patients' medical records and ship the records to your new Johnson County office.

2008 -- While in possession of the stolen medical records, store the records in a garage, store them in an investigator's dining room, and instruct your staff to make copies of medical records at a retail store.


2009 -- When you lose the Republican primary election to retain your current position as Johnson County DA and get a visiting law professor job (bwahahahaha) at Liberty University Law School in Virginia, have your staff mail patients' medical records to Virgina.

One more important piece of information you should know about.

The article on Dr. Tiller's acquittal reports that moments after the verdict was announced the state's medical board announced it was investigating similar allegations against him. What the article omits to mention is that the medical board's petition* against Dr. Tiller is based on a 2006 complaint (amended in 2007) filled by Operation Rescue spokesperson Cheryl Sullenger**.

Archbishop Joseph Naumann: Liar for Jesus

What kind of a depraved liar do you have to be, to be Archbishop Joseph Naumann?

In related news, Archbishop Joseph Naumann, head of the Archdiocese of Kansas City, recently said that Kansas Gov. Kathleen Sebelius (D) should not receive Holy Communion because of her support for abortion rights....

...

According to Naumann, Sebelius' veto last month of an abortion-related bill showed a lack of respect to Kansas lawmakers and residents, who are embarrassed that Kansas "has become infamous for being the late-term abortion center for the Midwest"....


Kansas law prohibits elective, and most medical, late second trimester abortions. The only late-term abortions performed in Kansas are those done to preserve the woman's life or avoid a "substantial and irreversible impairment of a major bodily function" of the woman.

So according to this deranged person, Archbishop Joseph Naumann, Kansas lawmakers and residents are all psychopaths who are embarrassed that some pregnant women in their state have life-threatening medical problems.

What's next, a proposal from Archbishop Joseph Naumann to force all women with problem pregnancies into exile to neighboring states in order to achieve that most desirable statistic of all, zero late-term abortions in Kansas?

I guess objecting to science and facts is no longer enough for religionists. They're now objecting to the very existence of sick pregnant women. Because what better way to eradicate late-term abortions than to do away with the pregnant women who need them.

Phill Kline and Leslee Unruh: All Your Medical Records Are Belong to Us




In March, a Johnson County, Kan. grand jury, convened as a result of a petition from forced pregnancy terrorists, has refused to issue an indictment against Planned Parenthood after investigating the agency’s clinic in suburban Kansas City.

Last week, the Kansas Department of Health and Environment filed a motion to dismiss Johnson County, Kan., District Attorney Phill Kline's (R) subpoena that requires the department to authenticate records from Planned Parenthood of Kansas and Mid-Missouri's clinic....

According to the Kansas City Start the issue with the Department of Health and Environment is whether Kline will be allowed to use as evidence the state health records that are the basis for his prosecution of the family planning agency.

Hopefully the new South Dakota proposed initiative, the one that mandates the submission of the abortion patient's medical history to the Department of Health and makes her medical record available on demand, will be enacted into law so as to spare Comrade Leslee Unruh and other assorted South Dakota forced pregnancy terrorists all the effort Phill Kline has to expand just to get access to some bedtime reading.

Kansas Supreme Court Blocks Forced Pregnancy Outfit's Witch Hunt Attempt




Good news from Kansas, for a change. First, [o]n Feb. 5, the Supreme Court granted a...request by Tiller's lawyers to delay the enforcement of a subpoena for five years' worth of records of 2,000 women who sought abortions 22 weeks or later into their pregnancies. Those would be the patient records requested by a grand jury empaneled after the forced pregnancy outfit Kansans for Life got seven thousand people to sign a petition. [You know, how you do when you just absolutely, positively must rummage through a stranger's medical chart for a bit of titillation.]

Not deterred by the failure of their initial scheme, [t]he grand jury then subpoenaed Six's [Kansas' Attorney General] office for records from 2003, obtained during an investigation when Phill Kline held the office. This prompted Attorney General Six to appeal the subpoena to the Supreme Court, resulting in a second bit of good news from Kansas:

Citing "significant issues" regarding patient privacy and a grand jury's authority to issue subpoenas, the chief justice of the Kansas Supreme Court on Tuesday temporarily blocked enforcement of a grand jury subpoena from Sedgwick County, Kan., of medical records of women who obtained abortions after their 21st week of pregnancy at physician George Tiller's Wichita clinic, Women's Health Care Services.... The subpoena from the grand jury had ordered state Attorney General Stephen Six (D) to turn over the records of 60 women who obtained abortions at the clinic by Wednesday.


So many patient charts, so little time to 1) lie about the real reason you want to get your hands on those charts, 2) go to extraordinary lengths to expose the patients' identities, and 3) generally abuse and demean Kansas women who dare think their medical charts are not public information.

Medical Records of 2,000 Kansas Women to Be Surrendered to Grand Jury

Seven thousand strangers in your area sign a petition because they want to know whether an area doctor obeyed state laws governing normal vaginal deliveries. Based on their petition a grand jury is empaneled and a judge orders the doctor to immediately surrender the medical records of 2,000 patients.

The debasing of female patients, Kansas ones in particular, continues unabated.

Phill Kline Sues Planned Parenthood...Again

If you want a preview of what will happen to your medical records once abortion is banned in the U.S., pay close attention to the demented antics of Kansas' very own Phill "Patient Chart Thief" Kline.

After being ousted as Kansas' Attorney General, but before leaving office to become the Johnson County District Attorney, Phill "Patient Chart Thief" Kline stole the medical records of 90 patients who had post-22-week abortions in 2003 at Comprehensive Health or Women's Health Care Services in Wichita, Kan.:

2004 - Kline subpoenas patient records.

February 2006 - State Supreme Court rules Kline can seek access to the records but not before he presents his reasons for seeking the subpoenas to District Court Judge Richard Anderson.

November 2006 - Judge Anderson turns over patient charts to Kline's office.

November 2006 - Paul Morrison, Johnson County district attorney, defeats Kline and becomes the new Kansas Attorney General.

January 5, 2007 - Kline forwards copies of patient charts to the Johnson County district attorney's office.

January 8, 2007 - Kline leaves the state attorney general's office for the Johnson County district attorney's office where he replaces Morrison as the new district attorney.

June 2007 - After finding no evidence of any criminal wrongdoing by the clinic, Kansas Attorney General Paul Morrison ends the investigation of Comprehensive Health.

June 2007 - Morrison also informs Comprehensive Health that Kline, the Johnson County district attorney, retains copies of the patient charts and he finally tells the clinic about Kline forwarding copies of the charts to the Johnson County district attorney's office on Jan. 5.

June 6, 2007 - The clinic files a petition with the state Supreme Court for a writ of mandamus against Kline.

June 22, 2007 - State Supreme Court tells Kline he has until July 12 to respond.

Unfortunately, no further information is available about this lawsuit. Those involved have not discussed the case and the documents are sealed.

Putting the stolen charts to good use, Phill "Patient Chart Thief" Kline sues Planned Parenthood again, and then some more:

October 2007 - Kline files a 107-count criminal complaint against Planned Parenthood. The complaint consists of 23 felonies and 84 misdemeanors, alleging unlawful late-term abortions and inadequate record keeping at Planned Parenthood's Comprehensive Health clinic in Overland Park.

December 2007 - Kansas Attorney General Morrison acknowledges having an extramarital affair with a former subordinate in the district attorney's office.

According to the AP:

[The woman] also accused him of harassment and trying to get her to provide sensitive information on Kline's activities, including his investigation of Planned Parenthood.

Morrison has denied the allegations of professional misconduct, but he plans to step down as attorney general Jan. 31. Kline has said he will appoint a special prosecutor to investigate Morrison's conduct.


January 16, 2008 - Judge Stephen R. Tatum denies Kline's motion to disqualify two attorneys representing Planned Parenthood.

Phill "Patient Chart Thief" Kline alleged that Planned Parenthood altered patient records before turning them over to Judge Anderson in 2006 as part of Kline's initial criminal investigation. From the AP article:

Kline based his records allegations on testimony that Shawnee County District Judge Richard Anderson gave Wednesday. Anderson is the judge who at Kline's request subpoenaed the records in 2004 after Kline - then Kansas attorney general - began his initial Planned Parenthood investigation.

Anderson testified that records he eventually received from Planned Parenthood in 2006 - after the agency fought the subpoenas - did not match the original records. Anderson said the questionable records were the same ones that current Attorney General Paul Morrison reviewed when he cleared Planned Parenthood of wrongdoing last year.

Based on that, Anderson said he does not believe Morrison should have issued his letter clearing the agency.


However, despite Judge Anderson's testimony and Kline's allegations:

Judge Stephen R. Tatum said after the hearing that Kline did not present evidence that proved the attorneys should be removed from the case.

...

Tatum said Kline cannot show that the attorneys had anything to do with preparing the records.


Furthermore, not only did Planned Parenthood officials say that Kline's allegations about the records possibly being altered are false, but according to Irigonegaray (one of the attorneys Kline sought to remove):

Kline filed the motion to disqualify the attorneys to draw publicity about the criminal charges. "It was a complete waste of the court's time and everyone else's," PPKM President Peter Brownlie said, adding that Kline "produced absolutely no evidence of anything that would disqualify our attorneys so clearly he had some other reason for it."

Kline said he wanted to present the information now so PPKM could not appeal a verdict on the basis of ineffective counsel. "These documents were manufactured and are false information, and counsel represented them to be something they are not," Kline said.... Irigonegaray disagreed, saying, "We were very disturbed by Mr. Kline's efforts to put on the record information that's not only erroneous, but without any basis in fact"....


Bottom line: It's easy to dismiss Phill "Patient Chart Thief" Kline as the pustulant voyeur that he is and to regard what's going on in Kansas as some peculiar regional drama. What's not so easy is to realize that any one of us might be part of the next batch of 90 female patients whose medical information is at the abject mercy of assorted miscreants.
